Securities lending has been a lucrative business for mutual funds and exchange-traded funds over the past decade. Unfortunately for investors, the sponsors of these funds have not been very transparent with the details of their securities lending programs, and consequently most investors in these funds are unaware of their exposure to the risks inherent in securities lending. Interestingly, most funds do not return the full profits from securities lending activities to their investors. In this paper, we examine and discuss the (...) ethical considerations related to the securities lending activities of mutual funds and ETFs and offer a series of best practices that we believe will provide better transparency of these activities to fund investors. Life‐threatening illness is associated with financial burden among families. During this time, care‐related expenses often increase. The concept of financial burden has not fully been explored nor conceptually described in the literature. Our study coalesces the empirical literature on financial burden into a more comprehensive multidimensional theoretical framework to understand financial burden among patients and families dealing with serious illness. Using Jabareen's phased approach for building conceptual frameworks, we synthesized the existing scientific literature (including existing measures of financial burden) to (...) construct an empirically derived model. Definitions of financial burden are overlapping with similarities, but also inconsistencies. Many studies have focused more on objective and operational definitions, than subjective and conceptual aspects. Regarding measures for financial burden, many studies have only used a few items. The financial burden is dependent on the illness trajectories and duration. By considering multidimensionality, we illustrate potential financial burden factors (objective, coping, and subjective). Although anticipation and expectations about future financial issues are important, patients and caregivers generally experience objective aspects of burden, followed by subjective impressions of burden. Coping skills likely reduce subjective burden. Based on the results, we redefine the financial burden among patients with life‐threatening illness and caregivers. (shrink)

RAID-II is a high-bandwidth, network-attached storage server designed and implemented at the University of California at Berkeley. In this paper, we measure the performance of RAID-II and evaluate various architectural decisions made during the design process. We first measure the end-to-end performance of the system to be approximately 20 MB/s for both disk array reads and writes. We then perform a bottleneck analysis by examining the performance of each individual subsystem and conclude that the disk subsystem limits performance. By adding (...) a custom interconnect board with a high-speed memory and bus system and parity engine, we are able to achieve a performance speedup of 8 to 15 over a comparative system using only off-the-shelf hardware. This paper argues that phenomenal consciousness is what makes an entity a welfare subject. I develop a variety of motivations for this view, and then defend it from objections concerning death, non-conscious entities that have interests (such as plants), and conscious entities that necessarily have welfare level zero. I also explain how my theory of welfare subjects relates to experientialist and anti-experientialist theories of welfare goods.

I develop and defend a sense-datum theory of perception. My theory follows the spirit of classic sense-datum theories: I argue that what it is to have a perceptual experience is to be acquainted with some sense-data, where sense-data are private particulars that have all the properties they appear to have, that are common to both perception and hallucination, that constitute the phenomenal characters of perceptual experiences, and that are analogous to pictures inside one’s head. But my theory also diverges from (...) conventional sense-datum theories in some key respects: on my view, (1) sense-data are first-person presentations of neural states, (2) the sensational qualities of sense-data differ in kind from the sensible qualities of external objects, and (3) sense-data are the vehicles in virtue of which we perceive, rather than the objects that we perceive. I argue that this package of claims is appropriately labeled ‘sense-datum theory’, and that the resultant view ought to be a live contender in contemporary philosophy of perception. (shrink)

Michelle Maiese and Robert Hanna’s The Mind-Body Politic sets out to combine both the philosophy of essentially embodied cognition (EEM) and emancipatory political theory to put forth a “new critique of contemporary social institutions.” There remains, however, an explanatory gap between the general, normative foundations of their approach in EEM, and the particular critiques of neoliberalism and the alternative presented. This research note analyzes the relationship between indicators of corporate social and financial performance within a comprehensive theoretical framework. The results, based on data for 67 large U.S. corporations for 1982-1992, reveal no significant negative social-financial performance relationships and strong positive correlations in both contemporaneous and lead-lag formulations.

Mere inability, which refers to what persons are naturally unable to do, is traditionally thought to be distinct from unfreedom, which is a social type of constraint. The advent of biomedical enhancement, however, challenges the idea that there is a clear division between mere inability and unfreedom. This is because bioenhancement makes it possible for some people’s mere inabilities to become matters of unfreedom. In this paper, I discuss several ways that this might occur: first, bioenhancement can exacerbate social pressures (...) to enhance one’s abilities; second, people may face discrimination for not enhancing; third, the new abilities made possible due to bioenhancement may be accompanied by new inabilities for the enhanced and unenhanced; and finally, shifting values around abilities and inabilities due to bioenhancement may reinforce a pre-existing ableism about human abilities. As such, we must give careful consideration to these potential unfreedom-generating outcomes when it comes to our moral evaluations of bioenhancement. (shrink)

A famous mathematical theorem says that the sum of an infinite series of numbers can depend on the order in which those numbers occur. Suppose we interpret the numbers in such a series as representing instances of some physical quantity, such as the weights of a collection of items. The mathematics seems to lead to the result that the weight of a collection of items can depend on the order in which those items are weighed. But that is very hard (...) to believe. A puzzle then arises: How do we interpret the metaphysical significance of this mathematical theorem? I first argue that prior solutions to the puzzle lead to implausible consequences. Then I develop my own solution, where the basic idea is that the weight of a collection of items is equal to the limit of the weights of its finite subcollections contained within ever-expanding regions of space. I show how my solution is intuitively plausible and philosophically motivated, how it reveals an underexplored line of metaphysical inquiry about quantities and locations, and how it elucidates some classic puzzles concerning supertasks. Critical realism provides an alternative to positivism and interpretivism. It foregrounds ontology and an evaluative approach to knowledge, while promoting eclectic reasoning, transdisciplinarity, and ethical research across the quantitative/qualitative, macro/micro and other divides. Health researchers have usefully employed critical realism, though it has also been dismissed as strange, a source of self-deception and hubris. Furthermore, it has been accused of dehumanizing many people. Responding to these charges, this article makes the case for carefully employing critical realism within and beyond social (...) studies of health. It first outlines some basic critical realist tenets before summarizing two exemplars within the sociology of health, illness and medical work. The discussion section, observing the principle of hermeticism, engages with some criticisms before offering a prolegomenon to research on the COVID-19 pandemic response. In conclusion, a ‘radical’ proposal is ventured for possible transformative action so that society is less hierarchical, more equal and salutogenic. (shrink)

The debate includes contributions from Randy Barnett, Steven Calabresi, Kurt Lash, Gary Lawson, John McGinnis with Michael Rappaport, Michael Paulsen, and Lee Strang, not to mention Justice Antonin Scalia—all representing originalism in some form. Living constitutionalism has also been represented both implicitly and explicitly, with important contributions from Phillip Bobbitt, Ronald Dworkin, Michael Gerhardt, Randy Kozel, and David Strauss. This paper argues that in Eudemian Ethics 8.3, virtue’s mean between excess and deficiency is defined by the standard of promoting the most contemplation. Promotion is indirect and constrained by virtue’s other essential features. The chapter’s apparent restriction of the standard to actions concerning natural goods actually serves a dialectical, not a restrictive, purpose. This paper proposes to unify the chapter’s argumentative arc.

You ought to believe in accordance with available evidence. This evidential norm, as widely recognized, can be implausibly demanding by requiring you to hold pointless beliefs. In this paper, I first consider some seemingly promising versions of the positive evidential requirement to form beliefs in accordance with your evidence and argue that they either fail to avoid the problem of pointlessness or fail to bind you independently of practical requirements. I then show that even the negative requirement not to believe (...) against your evidence falls prey to the same problem: either it enjoins pointlessness or its binding force depends essentially on practical norms. This is puzzling, as our epistemic practice seems to presuppose evidential standards that are independent of practical rationality. I suggest that the alleged evidential “norms” are evaluative ‘ought’-statements about what it would be epistemically ideal for you to do, which, on their own, do not issue any genuine prescriptions or demands. Let a "smooth experience" be an experience with perfectly gradual changes in phenomenal character. Consider, as examples, your visual experience of a blue sky or your auditory experience of a rising pitch. Do the phenomenal characters of smooth experiences have continuous or discrete structures? If we appeal merely to introspection, then it may seem that we should think that smooth experiences are continuous. This paper (1) uses formal tools to clarify what it means to say that an experience is continuous (...) or discrete, and (2) develops a discrete model of the phenomenal characters of smooth experiences. As a result, I'll argue that introspection leaves open whether smooth experiences are continuous or discrete. Yet I’ll also argue—perhaps surprisingly—that the discrete theory may better fit our introspective evidence. Along the way, I explain why the sense of ‘continuity’ ascribed to smooth experiences is distinct from the sense of ‘continuity’ ascribed to the stream of consciousness. (shrink)

When are logical theories equivalent? I discuss the notion of ground-equivalence between logical theories, which can be useful for various theoretical reasons, e.g., we expect ground-equivalent theories to have the same ontological bearing. I consider whether intertranslatability is an adequate criterion for ground-equivalence. Jason Turner recently offered an argument that first-order logic and predicate functor logic are ground-equivalent in virtue of their intertranslatability. I examine his argument and show that this can be generalized to other intertranslatable logical theories, which supports (...) the following: intertranslatability implies ground-equivalence. I also argue, however, that this ground-equivalence argument can be challenged as it faces a dilemma. The dilemma arises because the argument allows two distinct readings, the ‘internal’ and the ‘external’ reading. I argue that the argument turns out to be unsuccessful in both readings. The upshot of this dilemma in both philosophy of logic and metaphysics is considered. (shrink)

The growing demand for uterus transplantation (UTx) invites continued philosophical evaluation of the function of UTx (and what constitutes its ‘success’), as well as the recipient eligibility for UTx. Currently, UTx caters to partnered, cisgender women of childbearing age looking to get pregnant and give birth to a biogenetically related child. The medical justification for this—the treatment of uterine infertility—explains the primacy of this practice. However, this dominant conceptualization of UTx does not necessarily capture the diverse needs for which both (...) cis‐ and transgender women might take interest in UTx that are not strictly procreative, such as bodily integrity and gender identity reasons. This essay introduces the concept of lived religion from religious studies, elucidates why this lived religion approach is crucial for redefining "religion," and illustrates its application in the domain of religious vaccine exemptions. A global trend of institutionalised pronatalism situates low fertility as a site of demographic disaster – positioning primarily women’s bodies as both its cause and solution. In light of such demographic dread, assisted reproductive technologies (ART) may be utilized by pronatalist states as a strategy for fertility recovery, rather than as a benefit for individual aspiring parents. In other words, ARTs are at risk of being co-opted by nation-states for problematic demographic designs which do not advance emancipatory goals. The underlying (...) issue of pronatalism, however, is not always explicitly acknowledged in feminist bioethics as a barrier to ethical ART usage. In my paper, I argue that it would be a mistake to assume ART can be used for emancipatory ends if we do not, at the same time, critically investigate its connections to institutionalised pronatalism. In this paper, I claim that live uterus donors ought to be considered for the possibility of compensation. I support my claim on the basis of comparable arguments which have already been applied to gamete donation, surrogacy, and other kinds of organ donation. However, I acknowledge that there are specificities associated with uterus donation, which make the issue of incentive and reward a harder ethical case relative to gamete donation, surrogacy, and other kinds of organ donation. Ultimately, I contend that (...) while reimbursement for the costs incurred by live uterus donors should be treated as a necessary ethical minimum, how much further we ought to remunerate uterus donations remains an open question. Engaging in the linguistic practice of explanation gives us no reason to skeptical in beliefs about corresponding metaphysical relations like causation or grounding. Moreover, those very linguistic practices can provide resources to justify beliefs in those relations. Bio-heteronormative conceptions of the family have long reinforced a nuclear ideal of the family as a heterosexual marriage, with children who are the genetic progeny of that union. This ideal, however, has also long been resisted in light of recent social developments, exhibited through the increased incidence and acceptance of step-families, donor-conceived families, and so forth. Although to this end some might claim that the bio-heteronormative ideal is not necessary for a social unit to count as a family, a more (...) systematic conceptualization of the family—the kind of family that matters morally—is relatively underexplored in the philosophical literature. This paper makes a start at developing and defending an account of the family that is normatively attractive and in line with the growing prevalence of non-conventional families and methods of family-formation. Our account, which we call a constitutive-affirmative model of the family, takes the family to be constituted by an ongoing process of relevant affective and affirmative relations between the putative family members. Disagreement is a common feature of a social world. For various reasons, however, we sometimes need to resolve a disagreement into a single set of opinions. This can be achieved by pooling the opinions of individuals that make up the group. This Element provides an opinionated survey on some ways of pooling opinions: linear pooling, multiplicative pooling (including geometric), and pooling through imprecise probabilities. While this Element gives significant attention to the axiomatic approach in evaluating pooling strategies, it also evaluates (...) them in terms of the epistemic and practical goals they might meet. In doing so, this Element connects opinion pooling to some philosophical problems in social epistemology and the philosophy of action, illuminating different perspectives one might take when figuring out how to pool opinions for a given purpose. This paper defends contextualism against relativists" "faultless disagreement’ objection, while focusing on the debate about the semantics of predicates of personal taste. Relativists argue that there exists the phenomenon of faultless disagreement, and that relativism is the only framework where we can provide an explanation of this phenomenon. Against this argument, I first suggest three categories of disagreement which are not a faultless disagreement, and I argue that all apparent cases of faultless disagreement belong to one of these three categories. In particular, I argue that the illusion of the existence of faultless disagreement arises when we have not specified the context of conversation in a sufficient way or when we have failed to notice that there is simply a conceptual disagreement. Recent attempts to provide a viable account of decision making under normative uncertainty through the use of voting procedures seem promising, but incomparable options pose a challenge. This paper focuses on the so-called Borda approach to decision making under normative uncertainty (MacAskill, Mind 125(500):967–1004, 2016 ; MacAskill et al., Moral uncertainty, Oxford University Press, 2020 ) and illustrates how an extended version of it aimed at accommodating incomplete preference orderings associated with normative theories fails. I propose a different account for (...) proponents fond of the voter-theoretic approach that is grounded by _approval voting_, which sufficiently addresses the problem of option incomparability and is pragmatically compelling due to its simpler structure. This study investigates the influence of old directors on corporate social responsibility (CSR) using roughly 25,000 firm-year observations from 2001 to 2015 in the United States. We employ the widely used selection, optimization, and compensation (SOC) model from psychology to explain the CSR decisions of old directors. Our results indicate that firms with a higher percentage of old directors tend to have lower engagement in CSR activities. To address endogeneity, we adopt the difference-in-differences method and use the event of sudden (...) deaths and unexpected retirements of old directors and find that our results remain robust. Our analysis also reveals that the negative impact of old directors on CSR is more significant in firms where directors receive fewer reputational spillover benefits from CSR initiatives and/or firms exhibiting poor corporate governance. In addition, this adverse impact of old directors comes from two effects: a reduction in efforts to enhance CSR strengths and an increase in inaction to address CSR concerns. Overall, these findings suggest that the CSR decision-making process of old directors involves assessing the costs and benefits of CSR engagements, consistent with our hypothesis derived from the SOC model. I argue that this view is an improvement over the account that Michael Ridge defends in his paper “Individuating Games”. This improvement involves a distinction between two kinds of individuation: constitutive individuation and relational individuation. I argue that this distinction does a better job at solving the various puzzles that are related to the synchronic and diachronic identity of games. Jean Bodin’s analysis in Six Livres de la République is often understood as evidence of his alleged political absolutism. This article examines Bodin’s theory of offices to argue that this is a misguided view of Bodin’s political thought. I begin by revisiting Bodin’s distinction between the “sovereignty” and the “government” of the state. It is in the analysis of the latter that Bodin constructs a normative doctrine warning of the dangers of “ seigneurial” rule. As I show, Bodin’s purpose was (...) to reject seigneurial rule by contrasting it with lawful rule, the mode of government in which public power was discharged according to law and custom, not by seigneurial will. Essential to Bodin’s analysis was a concept of public office that envisioned the officer as an independent intermediary “borrowing” public powers, not from higher magistrates or from the prince (as medieval lawyers traditionally argued), but only from the impersonal state. Spinoza semble adopter une position pleinement nominaliste lorsqu'il discue des notions universelles dans l'Ethique, mais on y trouve aussi plusieurs arguments où, semble-t-il, des universaux sont présupposés. La solution avancé par plusieurs commentateurs, y compris Haserot, est que le système spinoziste est d'inspiration platoniste, et qu'il faut réinterpréter les passages d'apparence nominaliste pour les accorder avec le platonisme ou l'essentialisme. J'argumente qu'un tel procédé n'est justifié ni par le texte ni par la structure du système de Spinoza.
